Regulations that concern delegations in the ICM

During the LIV International Council Meeting Nuremberg, the ELSA Network decided to amend our standing orders concerning the number of delegates and liabilities in situations, where National Groups approve foreign delegates to their own delegation in order to fill all nine positions.

Amended article in question is as follows:

5.5 Number of delegates

Members and Observers have the right to send nine delegates to each Council Meeting. The host of the Council Meeting in agreement with the International Board may increase this number.

If a Member or Observer can not fulfill all nine positions with its own members, the respective group can give free positions from its delegation to the members from other Member or Observer groups.

The national board of the person applying shall approve him/her as a delegate and shall bear the financial responsibilities for him/her.

The Council amended in the Council Meeting paragraphs 2 and 3. To the paragraph 2 the Council decided to add a clause stating that people filling extra positions must be members of other Member or Observer groups of ELSA. This will ensure that all participants are either members of the association or extra delegates that come to the Council Meeting with a special purpose (ELS, External, Expansion etc.) and will be permitted to participate through an agreement between International Board and the Organizing Committee.

As it comes to paragraph 3, Council decided to target the financial responsibility concerning fees of delegates participating the Council Meetings to the national group that person in question and/or his/her Local Group belong to. Council also set a requirement to the group that the foreign delegate comes from to approve the participation of this delegate in a foreign delegation. Therefore the procedure for having foreign delegates is as follows.

  1. Person A, member of ELSA AA wants to participate ICM but his own delegation is already full.
  2. Person A ask room from the delegation of ELSA BB since he has heard that they have empty seats in the delegation.
  3. ELSA BB agrees to take A to their delegation and asks a confirmation from ELSA AA.
  4. ELSA AA either:
    1. Approves A to participate in the delegation of ELSA BB and bear the financial responsibilities of A or
    2. Doesn’t approve ELSA BB to take A to their delegation since ELSA BB doesn’t want to bear financial responsibilities of A in case of a dispute.
